Terms of services

1. Introduction

1.1 The terms and provisions of these Standard Terms and Conditions (hereinafter referred to as the GTC) relating to health services are set out in the

(hereinafter referred to as Zenon Medical) and the Clients shall apply to the individual contracts for the provision of health care services between the Clients and Zenon Medical. Zenon Medical shall provide its services to Clients in possession of a medical licence.

1.2. The terms and conditions and provisions of the GTCs relating to non-medical services shall apply to the individual contracts between

(hereinafter referred to as Zenon Beauty) and the Clients for the provision of services. 

1.3. Zenon Medical and Zenon Beauty are hereinafter collectively referred to as Zenon Clinic. The provisions where the GTC refer to Zenon Clinic apply to both Zenon Medical and Zenon Beauty.

1.4. The purpose of the GTC is to set out the terms and conditions for the use of the services provided by Zenon Clinic and the rights and obligations of Zenon Clinic and its Clients.

1.5. The substantive scope of the GTC covers the use of health care services provided by Zenon Medical and other non-medical services provided by Zenon Beauty (hereinafter referred to as Services or separately as Service), as well as the the material terms and conditions associated with them. Zenon Clinic carries out its activities through its employees, agents, subcontractors and contractors for health care services. When providing a health care service, if an external subcontractor is used, Zenon Medical sells the service requested by the Client to the Client in its unchanged form. Zenon Clinic declares that it holds all regulatory authorisation required to provide the Services.

1.6. The personal scope of the GTC applies to all Clients (hereinafter referred to as the Client or Clients) using any of the Services provided by Zenon Clinic. When ordering certain Services, Customers are obliged to accept the provisions of these GTC and undertake to comply with them when ordering each Service. 

1.7. The service relationship between the Client and Zenon Beauty or Zenon Medical – depending on which Service is used – enters into force upon acceptance of the GTC. The Client enters into the Service Contract with reference to these GTC. The Parties expressly agree that these GTC shall form an integral part of the legal relationship between them. The legal declarations (in particular certain information notices) of the Parties contained in a separate instrument shall together constitute a mutual and unanimous expression of the Parties' will. By ordering the Service, the Client agreed to be bound by the provisions of the GTC and acknowledges that Zenon Clinic provides the Service on the basis of these provisions.

2. Applied legislation

For matters not covered by the GTC, the following shall be applied: 

  • Act V of 2013 on the Civil Code, 
  • Act CLIV of 1997 on Health Care, 
  • Act XLVII of 1997 on the Processing and Protection of Health and Related Personal Data, 
  • Decree No 16/2002 (XII. 12.) of the ESCSM on the professional conditions for same-day surgical and curative care,
  • Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, 
  • as well as professional guidelines, rules published in methodological guides, and in their absence, professional requirements published in literature 

3. Rights and obligations of Zenon Clinic

3.1. The Zenon Clinic undertakes to provide the Services in a professional manner, in accordance with the legislation in force and the Hungarian health professional protocols, and in accordance with the contract. The Services are provided by Zenon Clinic at its private clinic and cosmetic clinic located at 1052 Budapest, Deák Ferenc tér 3, 2nd floor, or – in case by Zenon Medical – by its contracted partners.

3.2. Zenon Clinic makes its opening hours available on its website. Zenon Clinic is entitled to change its opening hours, which is also provided on the Website.

3.3. The Services provided by Zenon Clinic are only be available by prior appointment. Appointments can be made by calling the telephone number indicated above or by using the online appointment booking interface on the website. To make an appointment, the Client is required to provide his/her name, telephone number and e-mail address and, in the case of patients under the age of 18, the details of a parent or guardian. Children under the age of 14 may only use the Services in the presence of their legal representative. Minors between the ages of 14 and 18 with limited legal capacity without the presence of their legal representative may use the Services provided by Zenon Clinic with the prior written consent of their legal representative. Zenon Clinic may subsequently inform the legal representative of the minor's medical condition. The sample declaration of consent for minors with limited legal capacity can be found on the Website. The sample is available after registration within the patient profile, in the menu item "downloadable documents, statements".

3.4. For anaesthesia and other surgical procedures, and in cases where Zenon Medical is temporarily unable to provide the Services at its own private clinic for reasons beyond its control, Zenon Medical is entitled to provide the Services at another health care facility under contract with Zenon Medical.

3.5. Zenon Clinic undertakes to receive and provide Services to Clients upon prior appointment. Prior to commencing the Service, the Client must complete the Registration Form and accept the Service Fee, which includes all fees and costs incurred in connection with the given Service. The completion of the Registration Form and the acceptance of the Service fee by the Client establishes a legal relationship between the Parties for the provision of the Service.

3.6. Zenon Clinic is entitled to remuneration for the provision of the Service according to the individually calculated Service Fee and according to the Service Fee specified in the official price list available on the Website. The amount of the Service Fee may vary depending on the nature of the given Service compared to the Service Fee indicated in the price list. Zenon Clinic provides information to the Client about the Service Fee. By accepting the Service Fee and the GTC and by using the Service, the Client agrees to pay the fee. If the Client does not have accepted terms and conditions for the Service to be used, Zenon Clinic may refuse to provide the Service without giving reasons. The Zenon Clinic is also entitled to refuse to provide the Service, even in the case of a valid contract, if the Client owes a fee to Zenon Clinic, has not complied with the rules and regulations of the Service, in particular with the regulations of the authorities, has refused to give consent to treatment, is insane, intoxicated or drunk when seeking the Service, or is violent or behaves in a violent manner towards the Zenon Clinic staff or other patients. 

4. Rights and obligations of the Client

4.1. The Client is obliged to pay the fee to Zenon Clinic in due time.

4.2. The Client acknowledges that, in order to use the Service, he/she must provide Zenon Clinic with the personal data indicated in the Data Protection Notice. In addition to the processing of the indicated data, by using the Service, the Client gives his/her consent to Zenon Clinic to request his/her identity card, address card, social security card in order to verify his/her identity and to view them in order to verify the data provided by the Client.

4.3. The Client is obliged to appear at the previously agreed time, in a physical and psychological condition suitable for treatments and examinations, or, if required by Zenon Clinic for the given Service, after preparation as prescribed, otherwise Zenon Clinic is entitled to refuse to provide the Service. The Client shall not be entitled to compensation for the Service that has been delayed or due to the Client's inadequate preparedness for the Service due to prior information. Due to the delay of patient examinations and surgeries and other interventions due to professional reasons, Zenon Clinic may not be able to start the Service at a later time or at all than the scheduled date. In the event of a delay of more than 30 minutes, the Client is entitled to request a new appointment, but is not entitled to any other compensation.

4.4. If the confirmation of the booked appointment is subject to the payment of an advance, the paid advance cannot be claimed back in case of the non-performance of the booked service due to cancellation within 24 hours, missed appearance or reasons such as the existence of contraindications at the given time of the appointment.

4.5. If the Client books an appointment for the Service but does not use it, the Client may cancel the Service free of charge at least 24 hours before the booked appointment. If the Client does not cancel the booked appointment under the above conditions - or cancels it within 24 hours - and does not show up for the examination, Zenon Clinic is entitled to a cancellation penalty. The amount of the penalty fee is set out in Zenon Clinic's current price list.

4.6. The Client has the right to choose from among the specialists affiliated with Zenon Medical. Zenon Medical ensures that the chosen doctor is the primary provider of the service until the Client's express request is directed to the choice of another doctor. Zenon Medical will arrange for the replacement of the doctor in the absence or incapacity of the chosen doctor. Zenon Medical undertakes to contact the Client immediately upon becoming aware of the unavailability of the chosen doctor and to inform the Client of the unavailability of the chosen doctor and whether it can provide a replacement doctor at the agreed time. If Zenon Medical is unable to provide a substitute doctor, or if the Client does not accept the substitute doctor, the Parties must agree on a new appointment. The Client is not entitled to compensation if the date has been changed for the above reasons. 

4.7. The Client may request detailed oral and written information about the medical treatment before using any Service. The Client accepts the information provided by Zenon Clinic for the use of the Service and, by signing them, acknowledges that he/she has been duly informed in advance. The Prospectus is information prepared by Zenon Clinic for Clients and communicated in a demonstrable manner in accordance with, Article 13 (2) of Act CLIV of 1997 on Health Care. The Prospectus provides detailed, general information about each intervention, the recommended and mandatory tests that precede it, the possible benefits and risks of having or not having each recommended test or intervention, the possible alternative procedures and methods, the process and expected outcome of care, and the recommended post-intervention activities and lifestyle.

4.8. The Client is obliged to make the necessary declarations in writing to carry out the processing and to make the declarations required by law. The Client acknowledges that if the Client refuses to sign the information or informed statements or statements of consent and health assessment required by law or requested by Zenon Clinic, Zenon Clinic is entitled to refuse to provide the Service and to claim damages from the Client if any damage has been caused in this connection.

4.9. The Client is obliged to inform the treating doctor before and during treatment of all facts, information, data and circumstances necessary to establish the medical history. In particular, the client must inform the treating doctor of his/her state of health, any previous or current illness, his/her medication, any medicines and other medicinal products he/she has taken or occasionally takes, any risk factors for health problems and his/her sensitivity to certain medicinal products.If the Client does not fulfil or does not fulfil properly the contractual and statutory obligation to inform Zenon Medical, Zenon Medical shall be exempt from the consequences arising therefrom, for which Zenon Medical or the treating physician shall not be held professionally or financially liable.

5. Terms and Conditions about the Service Fee

5.1. The Client is obliged to pay a fee for the Services provided by Zenon Clinic. The Fee is determined according to the Zenon Clinic price list or it can be an individually calculated Service Fee. The prices in the price list are gross prices in HUF.

5.2. Zenon Clinic is entitled to modify unilaterally the price list and its must indicate its current price list on its Website and at its registered office. The new price list is effective from the date of its publication.

5.3. In case of using outpatient care, the Customer is obliged to pay the fee for the Service to Zenon Medical directly after using the given Service. For cosmetic and other non-medical services, the Client shall also pay the Service Fee to Zenon Beauty after the use of the Service. 

5.4. Zenon Clinic is entitled to make the appointment subject to payment of a deposit or advance payment for certain Services.

5.5. If the fee for the Service is paid by a third party (e.g. insurance company, health insurance fund), Zenon Clinic may request a payment guarantee (contract, payment commitment, insurance cover certificate, etc.) from the third party before the Service starts. In case the payment guarantee is not received before the scheduled date, Zenon Clinic is entitled to refuse the Service or the Client is obliged to pay the Service fee in full amount.

5.6. It is considered a serious breach of contract if the Client is more than 15 days in arrears with the payment of the fee due. If the Client is late in making any payment, he/she will be liable to pay interest on late payments. Interest on late payment shall be calculated at twice the base rate of the prevailing central bank for the period of the delay.

5.7. The Client may not transfer or use the fees of the already paid individual treatment plan, pass or any package for other Services, they can only be used for the Services specified in the treatment plan or pass. Services already paid for cannot be transferred to a third party.

5.8. The Client has the option to request an English translation of the laboratory findings. The fee for translation of the laboratory findings - which may vary depending on the scope of the findings - is billed to the Client in addition to the service fee.

6. Complaint handling

6.1. Zenon Medical is primarily responsible for complaints related to the Health Service. The Client may submit complaints in person at Zenon Medical's headquarters at the customer service representative or in writing at the info@zenonclinic.hu email address.

6.2. Zenon Medical accepts complaints related to the health service only from the Client or from the Client’s authorized representative. Zenon Medical will adjudicate the complaint as soon as personally possible, but no later than 30 days from the date of the communication of the complaint or, in the case of a written complaint, from the date of its receipt, and will notify the Client in writing of the outcome.

6.3. If the Client is not satisfied with the response provided by Zenon Medical, The Client may contact the following bodies:

7. Termination 

7.1. The service relationship shall be terminated upon completion of the Service and payment of the Service Fee, by extraordinary termination or by mutual agreement of the Parties.

7.2. The legal relationship may be terminated by extraordinary notice with immediate effect only in the event of a serious breach of contract in the form of a written termination addressed to the other Party. In the event of serious breach of contract, the contract may be terminated if the other Party breaches any provision of the contract and fails to remedy the breach or deficiency within the time limit specified in the notice after receipt of written notice of the breach or deficiency.

7.3. Zenon Clinic is entitled to terminate the contract with immediate effect by written notice to the Client, in particular in the following cases:

  • the Client does not fulfil any of its information or payment obligations or performs it with a delay of more than 15 days;
  • the Client is in serious breach of any provision of the GTC.

7.4. In case of extraordinary termination based on the Client's breach of contract, Zenon Clinic is not obliged to refund the Service Fee.

7.5. The Client is entitled to terminate the contract with immediate effect by written notice to Zenon Clinic in the event of serious breach of the contract by Zenon Clinic. In the event of extraordinary termination, the legal relationship shall be terminated with immediate effect for the future, and Zenon Clinic shall immediately refund to the Client the fee already paid by the Client for the period not covered by the Service.

8. Confidentiality and data processing

8.1. The Parties are obliged to process the data obtained during the Service in accordance with the following legal provisions:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)
  • Act CXII of 2011 on Informational Self-Determination and Freedom of Information of Hungary.
  • Act XLVII of 1997 on the Processing and Protection of Health and Related Personal Data

8.2. The Parties undertake to protect and safeguard, keep confidential as business secrets, the data, confidential data, information, confidential information, documents which come to their knowledge in the course of the performance of the legal relationship governed by these General Terms and Conditions and to make every effort to ensure their adequate protection.

8.3. The Parties may only use such confidential data, and confidential information for the purpose of fulfilment of the contract, and the Parties may not disclose any data and information obtained, without prior written consent of the other Party, unless such disclosure is required by law. 

8.4. The Parties acknowledge and undertake that all data and information provided to each other are considered business secrets, as such shall be treated confidentially, and may not be disclosed to third parties or used in a manner other than the purpose of the legal relationship.

8.5. The Parties undertake not to disclose any data or information coming to their knowledge within the framework of this legal relationship to any third person or authority without the prior written consent of the other Party, except in cases where such disclosure is required by law. The above obligation of confidentiality shall remain in force during the term of the Contract and indefinitely after its termination for any reason. The Parties shall be liable for any damage resulting from any breach of this obligation of confidentiality.

8.6. The Client is not entitled to disclose to third parties what is said during consultations, treatments or surgeries, nor to publish it in a community forum, and any questions related to the service may only be discussed with the doctor who performed the procedure or with a representative of Zenon Clinic.

9. Contact

Any and all written communications (hereinafter referred to as a Mail)drawn up by either Party to the other Party on the basis of the Contract shall be regarded as delivered if such mails are given to the other Party personally, or are posted to the other Party’s address set forth in the Contract by postal mail, fax or e-mail.

The Mail shall be deemed to have been delivered to Zenon Clinic:

  • in case of personal delivery, upon receipt
  • in the case of a letter, no later than 8 days from the date of posting
  • in case of e-mail on the day on which Zenon Clinic confirms receipt.

The Client's primary communication channel is the email address provided on the Registration Form. The Client acknowledges and agrees that Zenon Clinic will send documents and other Mails relating to the Services to this email address. The Mail shall be deemed to have been delivered:

  • in case of personal delivery, upon receipt
  • in the case of a letter, no later than 8 days from the date of posting
  • in the case of e-mail, the day after sending.

All declarations made by the Parties shall be made in writing.

10. Final provisions

10.1. Zenon Medical and Zenon Beauty are business associations incorporated and operating under the laws of Hungary, having all the rights necessary to establish this legal relationship, exercise its rights and perform its obligations.

10.2. In the event of a dispute arising in connection with the Contract or its performance, the Parties shall attempt peaceful conciliation. The present GTC shall be governed by the Hungarian legislation and the Hungarian health professional protocols.

10.3. Zenon Clinic reserves the right to turn to a third-party service provider in order to collect claims arising from the relevant legal relationship with these GTC and to entrust it with the recovery of the claim. The costs of the measures taken to recover the claim shall be borne by the Client.

10.4. If any provision of these GTC becomes invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not be affected.

10.5. Zenon Clinic shall make every effort to ensure that any disagreements or disputes arising from these GTC are settled by the parties out of court. If any dispute cannot be settled by negotiation, the courts having jurisdiction and competence under the applicable Hungarian rules of procedure have exclusive jurisdiction in the dispute.

These GTC are effective from March 1, 2023.
